Limited or Dual Agency is when one agent handles both sides of the property transaction. Limited agency is legal in 45 out of 50 States, but many states (including Indiana) require written disclosure from the agent to both the buyer and seller that:
- the agent cannot give a contractual advantage to either party
- the agent cannot disclose particular motivations between the parties
- the Buyer will pay more than the offered purchase price for the property
- the Seller would accept less than the listed price of the property
